Terms of Use

Purpose

These Terms of Use (the Terms) govern access to and use of the Harbor solution, published by Synergiz Labs, including:

  • Harbor Platform
  • Harbor Player
  • Harbor Reader
  • And any related modules or services

Definitions

  • User: Any individual using the Harbor solution.
  • Customer: Any legal entity subscribing to a Harbor license or subscription.
  • Content: Any digital content (texts, images, videos, 3D models, data etc.) uploaded, created, or used through Harbor.

Access to the Service

Account access

Access to Harbor requires an active User account.

Users are responsible for maintaining the confidentiality of their credentials and all activities performed through their account.

Synergiz Labs reserves the right to suspend or restrict access to the service in the event of:

  • Violation of these Terms
  • Fraudulent activity or security threats
  • Failure to comply with contractual obligations

Authentication via third-party services

Harbor allows Users to register and log in using third-party authentication services, including Google Sign-In.

In this context:

  • Users authorize Harbor to access certain information from their Google account, such as name, email address, and account identifier, strictly required to create and manage the User account
  • Harbor never accesses or stores the User's Google account password
  • Authentication is handled directly by Google, in accordance with Google's own terms of use and privacy policies

Users remain solely responsible for the security and confidentiality of their Google account.

Synergiz Labs shall not be held liable for any unauthorized access to a Harbor account resulting from a compromise of the User's Google account.

Service Description

Harbor is a SaaS platform enabling, in particular:

  • Creation, organization, and management of immersive Content
  • Distribution of Content across multiple devices
  • Analysis of usage and performance metrics

Service features may evolve over time to improve quality and performance.

Intellectual Property

Harbor software, interfaces, trademarks, logos, and visual elements are the exclusive property of Synergiz Labs.

Customers retain full ownership of their Content.

By using the service, Customers grant Synergiz Labs a non-exclusive, worldwide, and limited license strictly necessary to host, process, and deliver the service.

User Obligations

Users agree to:

  • Comply with all applicable laws and regulations
  • Not upload or distribute illegal, infringing, or harmful Content
  • Not attempt to disrupt, damage, or compromise the platform's security or operation

Data Protection

Synergiz Labs processes personal data in compliance with applicable regulations, including the GDPR. Details regarding data processing are provided in the Privacy Policy.

Service Availability

Synergiz Labs uses reasonable efforts to ensure service availability but does not guarantee uninterrupted or error-free access, particularly during maintenance periods or force majeure events.

Liability

Synergiz Labs shall not be liable for:

  • Indirect or consequential damages
  • The use of Customer Content
  • Damages resulting from improper or unauthorized use of the service

In all cases, Synergiz Labs's liability is limited to the amounts actually paid by the Customer for the relevant subscription or license.

Termination

Access to the service may be terminated:

  • By the Customer, in accordance with applicable contractual terms
  • By Synergiz Labs, in the event of a material or repeated breach of these Terms

Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the competent French courts.
